Our approach ensures the process of making your Will is as straight forward as possible for you, as set out here:
- A brief initial telephone consultation to provide summary on how we can help.
- A visit to you at your home or place of business to provide you with professional advice. This meeting is at our cost. If you decide to work with us, we will take your instructions and discuss our charging structure.
- We will draft your Will.
- Once you have approved the contents, we will either provide instructions for, or attend, the attestation (signing and witnessing) of your Will. This must be done correctly for the document to become legally valid.
- We will provide ongoing professional advice whenever it is needed as well as support and revisions in accordance with our terms and conditions.
- We will offer advice on storage and additional services that may be useful to you.
Lasting Power of Attorney (‘LPA’)
As well as Wills and Trusts, we also provide professional advice on LPAs. These are important documents which allow you to appoint someone to act for you and make decisions for you in the event that you are unable to make them for yourself.
An example of this would be if you had lost the capacity to make decisions about your finances. Having an LPA in place means that should something happen causing you to be unable to make your own decisions then the appointed attorney could make decisions and act in your best interests. There are two types of LPA, covering health and Welfare, and property and financial affairs
It is important to note that LPA paperwork must be completed correctly to ensure that it is not rejected by the Office of the Public Guardian causing additional costs and worry. This is where we come in.
Not having an LPA in place could mean that your loved ones would have to apply to the Court of Protection. This can be a costly and time consuming process which can be avoided at what will be an undoubtedly difficult time. The need for an LPA has been highlighted in this video from the One Show: http://www.bbc.co.uk/
Trusts
There are many types of trusts all that have their own benefits and purposes. Some trusts are set up in life and some on death. The benefits could include anything from caring or providing for a disabled friend or family member, protecting your house to ensure that it passes to those you would like, or mitigating possible Inheritance Tax liabilities.
Here at Indigo Will Assist we can support you and carry out your wishes using any of the following trusts:
- Protective Property Trusts
- Life Interest Trusts
- Disabled Persons Trusts
- Discretionary Trusts
- Family Trusts
- Asset Protection Trusts
Document Storage
Storing your document(s) safely and securely is just as important as writing them. They need to be kept in a secure environment which can be easily accessed by your executors when the time comes. We are pleased to work with The Society of Will Writers to provide a storage solution for you.
If you would like to discuss your requirements, please don’t hesitate to contact us.
